These Terms of Service apply when you use goodmangrips.com.au or buy from us. Please read them before placing an order. By using the site or placing an order, you agree to these terms.
1. Who we are
The website goodmangrips.com.au is run by the trustee for Goodman Family Trust, trading as Goodman Grips (ABN 48 761 437 538), PO Box 3050, Erina NSW 2250 (“Goodman Grips”, “we”, “us”, “our”). You can contact us on 1800 801 901 or at sales@goodmangrips.com.au.
2. Your rights under Australian Consumer Law
Nothing in these terms excludes, restricts or changes any right or remedy you have under the Australian Consumer Law (ACL) or any other law that cannot be excluded. If anything in these terms conflicts with those rights, your rights under the law apply.
3. Using our website
- You must use the site lawfully and must not try to interfere with it, hack it, or use it to send spam or harmful code.
- We may update, change or take down parts of the site at any time, and we don’t promise that the site will always be available or free of errors.
4. Accounts
- You can create an account to check out faster and see your order history.
- Please keep your login details secure and tell us straight away if you think someone else has used your account.
- Please keep your details accurate and up to date.
- We may suspend or close an account that is being misused.
5. Product information and images
- We try to describe and show our products accurately. Photos and images are representative only. Colours can look different on different screens, and packaging may change from time to time.
- Product descriptions, sizes and specifications are given as a general guide.
6. Prices and GST
- All prices are in Australian dollars (AUD) and include GST.
- Shipping costs are shown at checkout before you pay.
- We may change prices at any time, but changes won’t affect orders we have already accepted.
7. Errors
We work hard to get prices and product details right, but mistakes can happen. If a price or description is clearly wrong, we may cancel the order (even after we have confirmed it) and give you a full refund. We’ll let you know before we do.
8. Orders and acceptance
- When you place an order you are making an offer to buy. We will send an order confirmation, but a contract is only formed when we accept your order, which happens when we dispatch it.
- We may decline or cancel an order, for example if an item is out of stock, there is a pricing error, or we suspect fraud. If we do, we will refund any amount you have paid.
- Stock is limited. If an item sells out after you order, we will contact you and refund that item.
9. Payment
- Payments are processed securely by Stripe. We accept major credit and debit cards, Apple Pay and Google Pay.
- We do not store your full card number. Stripe handles your payment details under its own terms and privacy policy.
- Your order is processed once payment is approved.
10. Shipping and delivery
- We ship within Australia only.
- Shipping is a flat A$20 per order, and free on orders over A$150 (unless stated otherwise at checkout).
- Delivery times are estimates only and may be affected by couriers, Australia Post and other things outside our control. See our Shipping page for more information.
- Please check your delivery address carefully. We are not responsible for delays or losses caused by an incorrect address you give us.
- Risk in the goods passes to you when they are delivered. Ownership passes to you once we have received full payment.
11. Returns and refunds
Change of mind returns within 30 days on unopened items; customer pays return postage. Faulty items are always covered under the Australian Consumer Law. Please see our Refund Policy for how to return an item or ask for a refund.
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
12. Safety and use of our products
- Ninja, climbing, obstacle and training activities carry a risk of injury. Use our grips, slings, chalk and training gear only for their intended purpose, follow any instructions, and check equipment for wear or damage before each use.
- Children and beginners should only use training equipment with proper supervision, and everyone should train within their ability and use suitable safety measures (such as crash mats) where appropriate.
- Chalk products are for external use only. Stop using them if irritation occurs and keep them away from eyes.
- To the extent permitted by law, you use our products at your own risk, and we are not responsible for injury or loss caused by misuse, incorrect installation, or use beyond the product’s intended purpose. This does not limit your rights under the Australian Consumer Law.
13. Coupons and promotions
- Coupon and promo codes may have conditions, such as a minimum spend, an expiry date, or limits on which products they apply to.
- Only one code can be used per order unless stated otherwise.
- Codes have no cash value, cannot be exchanged for cash, and may be withdrawn or changed at any time (this won’t affect orders already accepted).
14. Intellectual property
Goodman Grips™, our logo and other trade marks, along with the content on this site (including text, photos, graphics and designs), belong to us or our licensors. You must not copy, reproduce or use them without our written permission, except for personal, non-commercial viewing.
15. Limitation of liability
To the extent permitted by law, including the Australian Consumer Law:
- we are not liable for any indirect or consequential loss arising from your use of the site or our products; and
- where our liability for a failure to comply with a consumer guarantee can be limited, it is limited to (at our choice) replacing or repairing the goods, or paying the cost of replacing or repairing them, or refunding the price.
16. Privacy
We handle your personal information in line with our Privacy Policy.
17. Governing law
These terms are governed by the laws of New South Wales, Australia. You and we submit to the courts of New South Wales.
18. Changes to these terms
We may update these terms from time to time. The version on this page when you place an order applies to that order.
